Courtney Elgart, PARTNER
Courtney Elgart represents commercial entities and individuals in high value and high-profile commercial disputes, including litigation and arbitration. She formulates, directs, and executes case strategy including developing claims and defenses, discovery strategy, and trial strategy, and advises clients on the same. She has particular experience litigating contractual disputes, litigating arbitrability under California law, and representing clients in the entertainment and media industry.
Courtney has trial experience in state and federal court and in domestic and international arbitral forums. She has presented and cross-examined fact and expert witnesses, prepared witnesses for same, put on closing argument, and argued motions.
Prior to joining Sullivan & Triggs, Courtney was an associate at a large international law firm.
After graduating magna cum laude and Order of the Coif from Georgetown University Law Center, Courtney clerked for Judge Richard Andrews on the U.S. District Court for the District of Delaware, one of the busiest district courts in the country with a significant complex business litigation docket, and for Judge Guido Calabresi on the U.S. Court of Appeals for the Second Circuit.
Courtney's experience includes:
• Secured multi-million-dollar award for hotelier in arbitration.
• Secured multi-million-dollar award for profit participants in private arbitration.
• Secured multi-million-dollar award for claimant in private international arbitration.
• Persuaded court to reverse own written tentative opinion at oral argument and compel arbitration.
• Litigated over two dozen cases related to the 2020 general election. Courtney was part of a successful trial and appellate team that defended President Biden’s 2020 victory in Nevada against an election contest alleging widespread fraud. Courtney also deposed three members of Congress and elicited an admission relied on by the federal trial court to grant summary judgment against the members.
• Represented appellants, appellees, and amici in the U.S. Courts of Appeals for the Third, Fourth, Fifth, and Sixth Circuits, in the U.S. Supreme Court, and in the intermediate appellate and state supreme courts in California, Michigan, Nevada, New York, and Pennsylvania.
• Represented a criminal defendant in a five-week federal jury trial.
Before attending law school, Courtney was a legislative aide and Chief of Staff in the Massachusetts Legislature.
